Executive Order No. 635

AMENDING EXECUTIVE ORDER NO. 134, SERIES OF 1964
 AS AMENDED, CREATING THE PHILIPPINE NATIONAL VOLUNTEER SERVICE
COORDINATING AGENCY (PNVSCA)

            WHEREAS, the Philippine government has encouraged the promotion of volunteer service programs for national and international development and understanding;

             WHEREAS, to maximize the benefits that may be derived from volunteer service programs, it is necessary to place them under the close supervision of a single government agency;

             WHEREAS, it has been noted that due to lack of coordination, there are volunteer service organizations from foreign countries whose performance cannot be gauged properly as to the necessity of their presence in this country.

             WHEREAS, it is necessary to strengthen the Philippine National Volunteer Service Coordinating Agency so that it can effectively formulate guidelines, policies, organize and coordinate volunteer service programs in the country;

             NOW THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by law, do hereby order:

             Section 1.  Title – The Philippine National Volunteer Service Coordinating Office (PNVSCO) shall hereinafter named Philippine National Volunteer Service Coordinating Agency (PNVSCA).

             Section 2.  The Philippine National Volunteer Service Coordinating Agency hereinafter referred to as the Agency shall remain under the Office of the President and shall be under the close administrative supervision of the Senior Presidential Assistant.

             Section 3.  Aims and Objectives – The Agency shall have the following goals and objectives:

 a)      Formulate policies and guidelines concerning volunteer service plans and programs;

 b)      Coordinate programs and activities of domestic and all foreign governmental and private voluntary organizations in order that their services may be made to fit into the total national development goals;

 c)      Act as clearinghouse for all matters pertaining to volunteer services;

 d)      Organize and implement the national volunteer service program to give the educated youth and adults a constructive opportunity to use their talent and skills for national development and in carrying out programs of international cooperation;

 e)      Serve as a liaison between domestic and all foreign governmental and private voluntary organizations including the United Nations Volunteer Program under UNDP;

 f)        Strengthen and promote volunteer service through conferences, seminars, training  sessions and other related activities;

 g)      Administer all PNVSCA funds from all sources, including foreign aid in accordance with accounting and auditing requirements; receive gifts, donations, bequests and subventions from public and private entities; associations and private persons; and

 h)      Perform other functions and duties as may be provided by law.

             Section 4.  Organization – The Agency shall be headed by a Director and assisted by a professional staff and employees who shall be appointed by the Director in accordance with the Civil Service law and rules.

             Section 5.  Duties and Functions of the Director – The Director shall have the following duties and functions:

 a)         Implement the plans and programs of the Philippine Volunteer Service Program;

 b)         Advise and assist the Senior Presidential Assistant of the Office of the President on matters pertaining to volunteer services;

 c)         Provide consultative and advisory services to the various government and private agencies on matters pertaining to volunteer service;

 d)         Develop plans, programs and operating standards and techniques for the promotion of the objectives and functions of the Agency; and

 e)         Perform such other functions as may be assigned to the Director by the Senior Presidential Assistant relating to volunteer services.

             Section 6.  Creation of Multi-Sectoral Advisory Body – There is hereby created a multi-sectoral advisory body to encourage the widest participation of both government and non-government organizations engaged in volunteer service.  It shall be composed of representatives of selected government agencies, the interfaith groups, private/civic organizations and foreign and international organizations; to be organized and chaired by the Director of PNVSCA.

 Section 7.  Functions of the Multi-Sectoral Advisory Body – The multi-sectoral advisory body have the following functions:

 a)         Assist in the formulation of policies, plans and programs pertaining to volunteer services;

 b)         Provide consultative and technical advisory services on volunteer matters;

 c)         Enhance and strengthen linkages among and between various volunteer groups and client communities.

              Section 8.  Definition of Terms – For the purpose of this Order:

 a)       Volunteer Service Organization – means any domestic or foreign group of volunteer workers organized and trained to plan and implement local and domestic volunteer service programs.

 b)       Volunteer Service Program – refers to a volunteer service planned for implementation by a volunteer service organization.

 c)       Volunteer Service Workers – means any foreign volunteer service worker or a domestic volunteer service worker.

 d)       Foreign Volunteer Service Worker – refers to a member of a foreign volunteer service organization, recruited by or at the instanc
e of PNVSCA to perform or participate in a specified domestic development project.

 e)       Domestic Volunteer Service Worker – refers to a citizen of the Philippines who is recruited by or at the instance of PNVSCA to perform or participate in a specified domestic development project here or abroad.

  Section 9.  Admission of Foreign Volunteer Service Worker – No foreign volunteer service worker shall be admitted into the Philippines unless the sending foreign country or foreign private organization has entered into an agreement for foreign volunteer service program with the government of the Philippines.

 Section 10.  Registration – All volunteer service organizations and workers shall, before performing any volunteer service in any place in the country, register with PNVSCA.  All existing volunteer service organizations and workers now performing volunteer service in the country shall likewise register with PNVSCA within thirty (30) days after effectivity of this Order.

 Section 11.  Contents of the Registration Form – The registration statement shall set forth the following:

 a)      The registrant’s full name, age, place of birth, citizenship, civil status, principal business and residence addresses in the Philippines and elsewhere, if any.  If the registrant is a partnership, association or corporation, the application shall be accompanied by a certified copy of its character, articles of incorporation or associating constitution and by-laws and any other instrument relating to its organization, power and purposes;

 b)      The name of the foreign volunteer service worker’s domestic or foreign organization affiliation, passport and visa number;

 c)      A copy of the contracts of employment, or in the absence therefore, a full statement of the terms and conditions under which such person acts or agrees to work as a foreign volunteer;

 d)      A detailed statement of every activity which the registrant is performing or is assuming or purporting or has agreed to perform;

 e)      Such other statements, information or documents as the Director of the PNVSCA for the purpose of this may from time to time require.

              Section 12.   Change of Visa Status – No foreign visitor entering the Philippines or already in the country, shall apply for a change of status.

              Section 13.  Prohibited Acts – A foreign volunteer service worker shall not perform any of the following:

 a)      Accept other remunerative employment during his assignment.

 b)      Make, directly, or indirectly, any contribution of money or other things of value, or   promise expressly or impliedly to make any such contribution, in connection with any convention, caucus or other process to select candidates for any political office.

 c)      Participate in political activities.

 d)      Solicit contributions.

 e)      Act in violation of the rules and regulations prescribed by the PNVSCA.

              Section 14.  Penalty for Any Violation – Any foreign volunteer service worker who commits any of the above prohibited acts shall face corresponding cancellation of his visa and confiscation of his passport while any domestic volunteer service working committing any such violation shall face charges before our domestic court.

              Section 15.  Rules and Regulations – The Director shall promulgate such rules and regulations as may be necessary to implement the provisions of this Order.  Such rules and regulations shall be effective after fifteen (15) days following their publication in the Official Gazette.

Executive Order No. 708

             By virtue of Executive Order No. 708, dated July 27, 1981, reorganizing the Office of the President and creating the Office of the Prime Minister pursuant to the 1961 amendments to the Constitution under Section 23 thereof, the Philippine National Volunteer Service Coordinating Agency (PNVSCA) is now under the administrative supervision of the National Economic and Development Authority (NEDA).

MULTI-SECTORAL ADVISORY BODY RESOLUTION
NO. 1-2004

RESOLUTION RECKONING PNVSCA ANNIVERSARY DATE

             Whereas, the Philippine government created the Philippine National Volunteer Service Committee (PNVSC) through Executive Order No. 134  dated  17 December 1964 as an expression of the country’s international commitment to the declaration of the International Middle Level Manpower Conference held in Puerto Rico in 1962 to promote and harness volunteerism for socio-economic development and for global understanding;

               Whereas, recognizing the growing role of the PNVSC, it was necessary to provide the Committee with a more permanent structure and authority for effective coordination of the volunteer program by transforming PNVSC into the Philippine National Volunteer Service Office (PNVSCO) by virtue of the 4th Indorsement issued by the Office of the President on 3 October 1973;

               Whereas, the growth of the volunteer program in the country necessitated expanding the role and function of the PNVSCO to serve as a clearinghouse for all volunteer matters in the country, to formulate policies and guidelines in the implementation of a national volunteer program and to make volunteerism align itself with  the  country’s   development   goals,  Executive  Order  No.  635   issued   on   12 December 1980 amended Executive Order No. 134 and renamed PNVSCO as the Philippine National Volunteer Service Coordinating Agency (PNVSCA);

               Whereas,  the  PNVSCA traditionally  celebrates  its  anniversary  every  12 December being the date it acquired its present name;

              Whereas, it is deemed more fitting to reckon PNVSCA’s anniversary date from the date of PNVSC’s creation on 17 December 1964  inasmuch as Executive Order 635 did not provide for the abolition of the latter but rather renamed and strengthened it;

NOW, THEREFORE, the members of the Multi-Sectoral Advisory Body (MSAB) RESOLVE, AS IT IS HEREBY RESOLVED, to adopt 17 December as the official anniversary date of PNVSCA.

 GUIDELINES FOR THE REGISTRATION OF VOLUNTEER SERVICE ORGANIZATIONS AND VOLUNTEER SERVICE WORKERS

           Whereas, Section 10 of Executive Order No. 635 dated December 12, 1980, states that “all volunteer service organizations and workers shall, before performing any volunteer service in any place in the country, register with PNVSCA”;

           Whereas, registration shall promote and enhance professionalism, facilitation and recognition for volunteer service organizations and workers;

           Whereas, registration shall lead to the establishment of a database and network of volunteer service organizations and workers in the country;

 Whereas, Section 15 of Executive Order No. 635 also provides, that the Director of PNVSCA shall promulgate such rules and regulations as may be necessary to implement its provisions;

           NOW THEREFORE, to ensure efficient registration of volunteer service organizations and individual volunteer service workers, this set of guidelines is hereby adopted for implementation.

 Section 1.  Definition of Terms.  The following terms shall be defined as follows:

a)  Registration refers to the process by which an organization or an individual is recognized by PNVSCA as a participant and provider of various support to volunteering programs and activities.

b) Volunteerism refers to an act involving a wide range of activities, including traditional forms of mutual aid and developmental interventions that provides an enabling and empowering environment both on the part of the beneficiary receiving,  and the volunteer  rendering the act, undertaken for reasons arising from socio-developmental,  business or corporate orientation, commitment or conviction  for the attainment of the public  good and where monetary and other incentives or reward are  not the primary motivating factors.

c) Volunteer Service Organization refers to any local or foreign group that engages the services of volunteers in socio-economic and cultural development, humanitarian, civic activities, advocacy, capability building and networking for volunteerism; or one that is created specifically to recruit, train and deploy volunteers for such purpose.

d) Volunteer Service Worker refers to any individual, local or foreign, who is engaged in volunteerism in the country, whether on a full-time or part-time basis, and who is a bonafide member of a registered volunteer service organization.

 Section 2.   Who Shall Register.  All volunteer service organizations and their volunteer service workers as defined under Section I paragraph (c) of this Office Circular shall register with the Philippine National Volunteer Service Coordinating Agency (PNVSCA) in accordance with Section 10 of Executive Order No. 635.

Section 3.  Registration of Local Volunteer Service Organizations and Local Volunteer Service Workers

a.       A Local Volunteer Organization shall complete the PNVSCA 
      Volunteer Organization Registration Form and submit the same to 
      PNVSCA, including the following documents:

 i.      Copy of SEC Registration, Constitution and By-Laws and Articles of Incorporation, if applicable, or copies of certificates of accreditation from government agencies or other recognized accrediting institutions;

ii.       Profile of organization, to include list of officials, annual reports and other   relevant document such as brochures, flyers, fact sheets or the like; and

iii.      List of volunteers.

b.       PNVSCA shall review all applications for registration and issue a Certificate of Registration to the organization.

           c.       All bonafide volunteer members of the registered organization shall be 
                 considered registered with PNVSCA.

           d.      The effectivity of the registration shall be three (3) years commencing on 
                 the date of the issuance of the Certificate. The registration may be 
                 renewed  at the instance of the local  volunteer  organization.

Section 4.  Registration of Foreign Volunteer Service Organizations and Foreign Volunteer Service Workers

a.       A Foreign Volunteer Organization shall complete the PNVSCA Volunteer Organization Registration Form and submit the same to PNVSCA, including the following documents:

 i.    Profile of organization, to include list of officials, annual reports and other relevant document such as brochures, flyers, fact sheets or the like;

 ii.      List of volunteers; and

                        iii.       Certification or any document issued by the organization’s 
                               country of origin, through its foreign ministry or embassy, attesting 
                               to its legitimacy.

            b.      In the case of a government-based foreign volunteer service organization, 
                  a bilateral agreement must then be concluded between the authorized 
                  representative of the government of the applicant foreign volunteer service 
                  organization and the Department of Foreign Affairs (DFA), in the case of 
                  the Philippine government.

 c.     In the case of a non-government foreign volunteer organization, a 
      memorandum of agreement must then be entered into with PNVSCA. 

            d.     PNVSCA shall review all applications for registration and issue a 
                 Certificate of Registration to the organization.

            e.     All bonafide volunteer members of the registered organization shall be 
                 considered registered with PNVSCA.

            f.     The effectivity of registration shall be co-terminus with the validity of the 
                 bilateral or memorandum of agreement which may be renewed at the 
                 instance of the foreign volunteer organization.

            g.    All existing foreign volunteer service organizations and workers now 
                 performing volunteer service in the country shall register with PNVSCA 
                 within forty-five (45) days after effectivity of this Circular.  Thereafter, any 
                 violation of this Circular shall be subject to the penalty imposed under 
                 Section 14 of Executive Order No. 635.

Section  5.  Approval/Renewal of Registration.   All applications for registration and renewal of registration shall be reviewed by PNVSCA in accordance with this Circular, the provisions of Executive Order No. 635, and other Agency issuances. 

Section 6.  Effectivity.  This set of guidelines shall take effect fifteen (15) days following its publication in the Official Gazette or any newspaper of general circulation.

            All office orders and circulars inconsistent herewith are hereby modified or amended accordingly.

             The month of December of every year is declared as the National Volunteer Month (NVM) by virtue of Presidential Proclamation No. 55 issued on December 5, 1998.

             Presidential Proclamation No. 194 dated 7 December 1987 was also issued, recognizing the volunteers and their contributions to society.  Thus December of every year was declared in the Philippines as International Volunteer Day for Economic and Social Development.

             The celebration of these two significant milestones aims to create nationwide awareness and appreciation on the power of volunteerisn and the role it plays in the social, economic and political development in the country.

             For this year’s NVM celebration, the Search for Outstanding Volunteers was launched and being institutionalized by the Philippine National Volunteer Service Coordinating Agency in collaboration with NEDA and DILG, through the National Volunteer Month National Steering Committee.

             The search is open to all Filipinos, individuals (adult and youth categories) and organizations (group category) who currently provide volunteering service in the Philippines.

            Nomination forms can be obtained from the following agencies:

§         Philippine National Volunteer Service Coordinating Agency

§         NEDA Regional Offices

§         Department of the Interior and Local Government and its Regional Offices

§         Commission on Higher Education and its Regional Offices

§         Regional Planning and Development Office of the ARMM

             You are hereby encouraged to nominate volunteers in your area of jurisdiction and submit the same to the respective chairs of the Regional Search Committees c/o NEDA Regional offices and DILG field offices.  Deadline for submission of nomination is September 3, 2004.

            DILG Regional/Provincial/Directors are hereby directed to cause the widest dissemination of this Memorandum Circular.

                        and Search for Outstanding Volunteers (SOV)

                    Presidential Proclamation No. 55 mandates the celebration of National Volunteer Month (NVM) in December.  It aims to build a nationwide awareness and appreciation of volunteerism and the role it plays in the social, economic and political development of the country; create the environment for bolstering voluntary action in development; and recognize the noble acts of volunteerism by individuals, families, institutions and communities as vital partners in economic and community development.

                    As the focal agency for the celebration, the Philippine National Volunteer Service Coordinating Agency (PNVSCA) is putting up a calendar of events that includes activities of individuals, groups and organizations for NVM, and, as part of the celebration, the PNVSCA is conducting a yearly Search for Outstanding Volunteers (SOV) to recognize and highlight exemplary performance of Filipino volunteers in their chosen fields.

                    The search covers all Filipinos, individual (adult and youth categories) and organizations (group category), that currently provide voluntary service in the Philippines.  Nomination forms for individual and organizations category may be downloaded at www.pnvsca.gov.ph.  The deadline for submission of nomination to the Regional Search Committee is on 3 September 2004.
